Terms of Service

1. Service Agreement

These Terms of Service ("Terms") govern your access to and use of GoneProof, a DMCA takedown and content protection service for creators ("the Service"). The Service is operated by GoneProof ("we", "us", or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

GoneProof provides automated scanning, AI-powered leak detection, and DMCA takedown issuance to help creators protect their copyrighted content across the internet.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Submit takedown requests for content you do not own or control;
• Use the Service to harass, intimidate, or make knowingly false or fraudulent claims;
• Attempt to access, disrupt, or compromise the Service's infrastructure, APIs, or data;
• Upload content that is unlawful, infringing, defamatory, or otherwise prohibited;
• Reverse engineer, decompile, or otherwise attempt to extract the Service's source code or proprietary models;
• Resell or sublicense access to the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these acceptable use provisions.

3. Account Responsibility

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date. You agree to notify us immediately of any unauthorized use of your account.

4. Payment Terms

GoneProof offers the following subscription plans:

• Creator — $19.95/month for up to 50 monitored items;
• Pro — $29.95/month for up to 150 monitored items;
• Studio — $44.95/month for up to 500 monitored items.

Subscriptions are billed monthly in advance through our payment processor, Stripe. Payment is due at the beginning of each billing cycle. You authorize us to charge the applicable fees to your designated payment method until you cancel. Fees are non-refundable except as required by law. We may change pricing with at least 30 days' notice before the start of the next billing cycle.

5. Limitation of Liability

To the maximum extent permitted by law, GoneProof and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

The Service is provided on an "as is" and "as available" basis. While we strive for accurate detection and effective takedowns, we do not guarantee that every infringing copy of your content will be found or removed.

6. Termination

You may cancel your subscription at any time from your account dashboard; cancellation takes effect at the end of the current billing cycle. We may suspend or terminate your account if you breach these Terms, abuse the Service, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

7. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware. You consent to the personal jurisdiction of these courts.
